Artist Terms
1. Introduction
Welcome to HobbyMela.
These Artist Partner Terms ("Artist Terms") govern your participation as an Artist on the Hobbymela Platform.
These Terms form a legally binding agreement between HobbyMela ("HobbyMela", "we", "our" or "us") and you as an Artist ("Artist", "you" or "your").
By creating an Artist Profile, publishing content, listing products, offering workshops or otherwise participating as an Artist on the Platform, you agree to comply with these Artist Terms, the Hobbymela Platform Terms of Use, Privacy Policy and all other applicable Platform policies.
If there is any inconsistency between these Artist Terms and the Platform Terms of Use regarding Artist-specific obligations, these Artist Terms shall prevail to the extent of that inconsistency.
2. Purpose of the Platform
HobbyMela is a platform designed to celebrate creativity and enable meaningful connections between Artists, hobbyists, learners, businesses and creative communities.
The Platform enables Artists to:
- create a professional Artist Profile;
- showcase their portfolio and creative journey;
- list handmade products in the Artist Discovery Marketplace;
- receive enquiries for commissioned work;
- offer workshops and creative experiences;
- participate in community discussions;
- connect with potential customers and collaborators;
- receive corporate gifting and workshop enquiries; and
- build long-term visibility within the creative ecosystem.
Participation on the Platform does not create an employment, partnership, agency or franchise relationship between Hobbymela and the Artist.
3. Eligibility
To become an Artist on HobbyMela, you must:
- be legally capable of entering into a binding agreement;
- provide accurate and complete registration information;
- have the necessary rights to offer the products, services or workshops you publish;
- comply with applicable laws, including tax and consumer protection laws where relevant.
If you are registering on behalf of a business, studio or organization, you confirm that you are authorized to act on its behalf.
4. Artist Profile
Artists are responsible for maintaining an accurate, complete and professional profile.
Your Artist Profile may include:
- your name or business name;
- biography;
- profile photograph;
- portfolio;
- Video / Reel Content
- creative disciplines;
- studio details;
- location;
- website and social media links;
- awards or certifications;
- contact information made publicly available by you;
- workshop information;
- product listings.
You agree to keep your profile reasonably up to date.
HobbyMela may request additional information to verify your identity or business details where reasonably necessary.
Verification does not constitute an endorsement, guarantee or certification by Hobbymela.
5. Artist Responsibilities
As an Artist, you agree to:
- provide accurate information about yourself and your work;
- conduct yourself professionally when interacting with Users;
- respond to genuine enquiries within a reasonable time where practicable;
- honour confirmed workshop commitments;
- ensure that product descriptions are accurate and not misleading;
- comply with applicable laws and regulations;
- respect the intellectual property and privacy rights of others;
- maintain high standards of professionalism while representing yourself on the Platform.
Artists remain solely responsible for their business operations and the services they provide.
6. Artist Discovery Marketplace
The Artist Discovery Marketplace is intended to help Users discover Artists and their creative work.
Unless HobbyMela expressly introduces integrated commerce services in the future:
- Hobbymela does not sell products on behalf of Artists;
- Hobbymela does not process payments for product purchases;
- Hobbymela does not collect commissions on product sales unless separately announced;
- Users purchase products directly from the Artist;
- Artists are responsible for communicating with buyers regarding pricing, availability, payment methods, delivery, returns and warranties.
Artists are responsible for ensuring that all product information is truthful, complete and regularly updated.
7. Handmade & Authenticity
Artists should accurately represent the nature of the products they display.
Where products are described as:
- handmade;
- handcrafted;
- original;
- limited edition;
- custom-made; or
- artisan-made,
such descriptions should accurately reflect the product.
Artists must not knowingly misrepresent:
- factory-produced products as handmade;
- another person's work as their own;
- AI-generated work as entirely handmade where doing so would be misleading;
- counterfeit or infringing products as original creations.
HobbyMela reserves the right to seek clarification, request supporting information or remove listings that may mislead Users.
8. Product Listings
Artists are responsible for ensuring that their product listings include accurate information regarding:
- product descriptions;
- dimensions;
- materials used;
- colours;
- pricing;
- customization options;
- estimated production timelines;
- availability;
- care instructions (where applicable).
Product photographs should reasonably represent the actual product.
Minor variations arising from handmade production, lighting or display settings are generally acceptable, provided they do not materially mislead Users.
9. Pricing
Artists are solely responsible for determining the prices of their products and services.
Artists may modify pricing at any time, provided that confirmed orders or confirmed workshop bookings are honoured at the agreed price unless otherwise mutually agreed with the User.
Hobbymela does not control or negotiate pricing between Artists and Users.
10. Workshops & Creative Experiences
Artists may choose to offer workshops, demonstrations, masterclasses, exhibitions, retreats or other creative experiences ("Creative Experiences") through the Platform.
Artists are solely responsible for:
- planning and conducting their Creative Experiences;
- ensuring the accuracy of workshop descriptions;
- communicating prerequisites and skill levels;
- providing required materials where promised;
- complying with applicable health, safety and legal requirements;
- obtaining any licenses or permissions required by law;
- ensuring that venues are appropriate for the activity being conducted.
Participation in a workshop constitutes a direct arrangement between the Artist and the participant, except where Hobbymela expressly states that it is acting as the booking facilitator or service provider for a particular event.
Artists acknowledge that Hobbymela is not responsible for the quality, outcome or safety of workshops conducted by independent Artists.
11. Workshop Changes & Cancellations
If an Artist needs to reschedule, postpone or cancel a Creative Experience, the Artist must notify affected participants and Hobbymela as soon as reasonably practicable.
Artists should make reasonable efforts to:
- offer an alternative date where possible;
- communicate changes clearly;
- minimize inconvenience to participants; and
- comply with HobbyMela's Refund & Cancellation Policy where applicable.
Repeated cancellations or failure to honour confirmed workshops may result in restrictions on the Artist's ability to offer future Creative Experiences through the Platform.
12.Responding to Enquiries
Artists are expected to respond to genuine User enquiries within a reasonable period. Hobbymela may monitor enquiry activity and response status and may follow up with Artists or Users where an enquiry remains unanswered or requires assistance.
13. Corporate Enquiries
HobbyMela may receive corporate enquiries for creative workshops, employee engagement program, corporate gifting, commissioned artwork, installations, exhibitions, brand collaborations and other creative engagements.
For such opportunities, HobbyMela and the Artist may jointly develop and curate an offering, drawing on the Artist’s creative expertise and inputs. The scope, deliverables, timelines and commercial terms for the engagement will be mutually agreed between HobbyMela and the Artist.
HobbyMela may present the agreed offering to the corporate client and manage the engagement through to execution, in accordance with the agreed terms.
14. Intellectual Property
Artists retain ownership of all intellectual property rights in their original works, including but not limited to:
- artwork;
- craft designs;
- photographs;
- videos;
- workshop curriculum;
- written materials;
- product designs;
- logos;
- trademarks;
- branding.
Nothing in these Artist Terms transfers ownership of an Artist's intellectual property to Hobbymela.
15. License Granted to Hobbymela
To enable HobbyMela to operate and promote the Platform, the Artist grants HobbyMela a non-exclusive, worldwide, royalty-free, revocable license to:
- display the Artist's profile;
- reproduce product images and portfolio content;
- publish workshop information;
- feature the Artist in search results;
- include the Artist in newsletters, social media posts and promotional campaigns;
- use the Artist's name, logo and publicly available profile information solely for promoting the Platform and the Artist's participation.
This license is limited to purposes reasonably connected with operating, improving and promoting Hobbymela.
The Artist may request the removal of promotional content featuring their work where reasonably practicable, provided such removal does not affect content already published or legally required to be retained.
16. Artist Conduct
Artists play an important role in maintaining a respectful and inclusive creative community.
Artists agree to:
- communicate respectfully with Users;
- respond honestly to enquiries;
- treat participants fairly;
- refrain from discriminatory or abusive conduct;
- avoid misleading advertising or exaggerated claims;
- honour commitments made through the Platform;
- comply with HobbyMela's Community Guidelines and Trust & Safety Policy.
Artists must not engage in conduct that could reasonably damage the reputation of Hobbymela or undermine trust in the Platform.
17. Reviews & Ratings
Users may leave reviews and ratings based on their genuine experiences with an Artist's products, workshops or services.
Artists may respond to reviews respectfully but must not:
- submit fake reviews;
- encourage others to post misleading reviews;
- threaten or harass Users for leaving reviews;
- offer undisclosed incentives in exchange for positive reviews.
HobbyMela may moderate or remove reviews that violate its policies or applicable law.
18. Compliance with Laws
Artists are responsible for ensuring that their activities comply with all applicable laws, including those relating to:
- consumer protection;
- product safety;
- taxation;
- intellectual property;
- advertising;
- privacy;
- labour and employment (where applicable);
- health and safety.
Where an Artist is required to obtain registrations, licenses, certifications or permits, the Artist is solely responsible for maintaining them.
19. Suspension & Removal
Hobbymela may suspend, restrict or remove an Artist Profile where it reasonably believes that the Artist has:
- breached these Artist Terms or the Platform Terms of Use;
- repeatedly received legitimate complaints;
- provided false or misleading information;
- infringed another person's intellectual property rights;
- engaged in fraudulent or unlawful conduct;
- offered counterfeit or prohibited products;
- failed to honour confirmed workshop commitments without reasonable cause;
- otherwise acted in a manner that poses a risk to Users or the Platform.
Where appropriate, HobbyMela may provide the Artist with an opportunity to respond or rectify the issue before taking action.
Nothing in this clause limits HobbyMela's ability to take immediate action where necessary to protect Users, comply with legal obligations or safeguard the integrity of the Platform.
20. Limitation of Liability
To the maximum extent permitted by applicable law, HobbyMela shall not be liable for:
- disputes between Artists and Users;
- product quality, delivery or fulfilment;
- workshop outcomes;
- business losses suffered by Artists;
- loss of profits, goodwill or business opportunities;
- actions or omissions of Users or third parties.
Artists acknowledge that HobbyMela provides a platform for discovery and connection and does not guarantee any minimum level of visibility, enquiries, bookings or sales.
21. Indemnity
Artists agree to indemnify and hold harmless HobbyMela, its directors, employees and representatives against claims, liabilities, losses, damages and reasonable legal expenses arising from:
- products sold by the Artist;
- workshops conducted by the Artist;
- breach of these Artist Terms;
- infringement of another person's intellectual property rights;
- misleading product listings;
- violation of applicable laws;
- negligent, fraudulent or unlawful conduct by the Artist.
22. Termination
Artists may remove their profile and discontinue participation on the Platform at any time, subject to fulfilling any existing commitments to Users.
HobbyMela may terminate or suspend an Artist's participation in accordance with these Artist Terms and the Platform Terms of Use.
Termination does not affect rights and obligations that accrued before termination, including obligations relating to intellectual property, confidentiality, indemnity, dispute resolution and applicable legal requirements.
23. Changes to these Artist Terms
HobbyMela may update these Artist Terms from time to time to reflect changes in:
- Platform functionality;
- legal requirements;
- business practices;
- industry standards.
Updated Artist Terms will be published on the Platform together with the revised "Last Updated" date.
Continued participation on the Platform after the updated Terms become effective constitutes acceptance of the revised Artist Terms.
24. Governing Law & Dispute Resolution
These Artist Terms shall be governed by the laws of India.
Any dispute arising from these Artist Terms shall first be addressed through good-faith discussions between the parties.
If the dispute is not resolved within thirty (30) days, the parties may mutually agree to mediation.
If mediation is unsuccessful or not pursued, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with:
- a sole arbitrator appointed by mutual agreement;
- Mumbai, Maharashtra, India as the seat and venue of arbitration; and
- English as the language of the proceedings.
Nothing in this clause prevents either party from seeking interim relief before a court of competent jurisdiction where necessary.
